Add a State Tips

11/01/2013

Do you want to add a state to or amend portions of a previously-approved Compact filing and not sure if you are required to reopen the filing? If so, this weekly tip offers helpful guidance.

It is not always necessary to have a Compact filing reopened in order to add a new state. If your filing is not being used for mix and match, simply click on the Add State button at the top of the filing. You will be prompted to add the state and if applicable, prompted to remit state filing fees. Remember, there are no additional IIPRC filing fees for adding new states to your filing. Please make sure your company is licensed to do business for the applicable product lines in the added state. If you added a state to a Compact filing by mistake, please follow up with the IIPRC Office to request the state be removed from the filing. Please check "View Filing Log" to verify that the Compact has acknowledged the added state as this is the date on which the company is authorized to use the product in the added state.

If your filing has been marked for mix and match, it is necessary to reopen and update your Statement of Intent Schedule at the same time the new state is added to the Compact filing. Please send a Note to Reviewer to request the filing be reopened and provide the reason for reopening. For example, "please reopen this filing for the purpose of adding Arkansas and Montana and updating the Statement of Intent Schedule." For filings that are marked mix and match, the Compact will not acknowledge the added state until the Statement of Intent Schedule is completed for the added state.

If you are amending portions of a previously-approved Compact filing such as the Statement of Variability, Schedule Pages, or Actuarial Memorandum or Demonstrations, the filer must reopen the previously-approved filing and should not submit a new filing. Please send a Note to Reviewer to request the filing be reopened and provide the reason for reopening such as "please reopen this filing for the purpose of submitting revised actuarial memoranda which have been updated to reflect a change in the maximum nonforfeiture interest rate." If you are making changes to approved forms that have been issued, it will be necessary to make a new filing instead of reopening the previously-approved filing. If the forms in a new filing are replacing forms in a previously-approved Compact filing, please include this information in the filing description identifying the SERFF Tracking Number for the previously-approved filing.

If your situation does not clearly fit one of these scenarios or you have questions about the filing processes outlined in our Filing Information Notices, please contact the IIPRC Office for further guidance. Thank you!
